The historical background

For the first time the system of obligatory certification including in the field of fire safety, has been entered into Russia in 1992. All positions have been registered within FL RF from 7.02.1992 N 2300-1 "About protection of consumers". Safety and legal protection of citizens, and also the prevention life- and health-threatening situations arising because of unfair manufacturers and suppliers became the purpose of the new law. Two years later, in 1994 had been published one more law for fire code regulation in a society - specialized FL RF "About fire safety".

The list of goods, which were subject to obligatory certification, was made out by the separate decision or the order. So, before acceptance of the new law, manufacturers used the Order № 320 from 08.07.2002 in which for each kind of production standard documents accurately registered. Besides, there were some specialized centers, where obligatory certification was carried out.

The Federal Law № 123 "Technical regulations about fire safety requirements" (further Technical regulations – ТR) has been accepted with a view of simplification of obligatory certification procedure and as that the Russian system corresponded to the standards of fire safety accepted in the WTO. The matter is that in the European community exclusively voluntary form of certification and declaring of goods fire safety is accepted, and operates successfully, the decision on introduction of voluntary certification was accepted in Russia too.

Manufacturers can consider one of ten schemes of fire safety conformity, and four of them are offered in the form of conformity declaring, and six in conformity certification.

Declaring of conformity and fire safety conformity certification– in what are the essence and differences?

Production conformity to fire safety requirements is one of kinds of an estimation of fire safety conformity. According to article 145 of ТR nowadays for conformity one form of voluntary conformity and two forms of obligatory fire safety conformity is provided:

Voluntary conformity of production correspondence to fire safety requirements is carried out in the form of voluntary certification.

Obligatory conformity of production correspondence to fire safety requirements is carried out in the form of conformity certification to fire safety requirements.

Obligatory conformity of production correspondence to fire safety requirements is carried out in the form of conformity declaring.

Voluntary certification is the form of conformity of production correspondence to fire safety requirements which is spent exclusively at the initiative of the concrete manufacturer or the seller of production. The state doesn't oblige the enterprise to spend the given kind of certification but only gives conditions for its carrying out.

The similar kind of certification extends on the goods, services, manufacture processes, storage conditions, operation, realization, transportation, recycling etc. which aren't included into the list of the objects which are subject to obligatory conformity of production correspondence to fire safety requirements (see obligatory certification).

More often, voluntary certification is necessary for goods conformity for the international standards or even standards of the organization in the field of fire safety. Passage of procedure of voluntary certification allows to raise level of trust of consumers to the given kind of production or to expand commodity markets.

Obligatory conformity is carried out in two kinds: certification of conformity and conformity declaring. On the basis of results the certificate of conformity or the declaration about conformity stand out.

The main difference between certification of conformity and conformity declaring is a balance of responsibility between the manufacturer and the accredited certification authority for real production fire safety. The matter is that under the Russian laws responsibility for the found out discrepancy between characteristics of production and the data declared in the document is born exclusively by the one who has accepted the declaration or has signed the certificate.

Conformity declaring is spent on the basis of the documents made by the manufacturer of production so, the manufacturer bears full responsibility for own goods. And it is not always necessary to confirm the received conclusions by specialized certification authority.

Conformity certification is spent by specially accredited independent authority. It means that independent experts will estimate fire safety; they will do conclusions about characteristics of production and bear responsibility for quality of the carried certification.

ТR provides ten variants of certification confirmation schemes, which are different in duration of procedure, in quantity of necessary proofs and in periods of validity.
